The term “Judge" is explained in The Penal Code under Section-

The penal Code,1860: Section-19. “Judge”:
The word “Judge” denotes not only every person who is officially designed as a Judge, but also every person,- 
-who is empowered by law to give, in any legal proceeding, civil or criminal, a definitive judgment, or a judgment which, if not appealed against, would be definitive, or a judgment -which, if confirmed by some other authority, would be definitive, or 
-who is one of a body of persons, which body of persons is empowered by law to give such a judgment. 
Illustration:
(a) A Collector exercising jurisdiction in a suit under Act X of 1859, is a Judge. 
(b) A Magistrate exercising jurisdiction in respect of a charge on which he has power to sentence to fine or imprisonment with or without appeal, is a Judge. 
(d) A Magistrate exercising jurisdiction in respect of a charge on which he has power only to commit for trial to another Court, is not a Judge.

দণ্ডবিধির ১৯ ধারার বিধান- জজ:
বিচারক অর্থ শুধু সরকারীভাবে বিচারক বলে আখ্যাত বা নিযুক্ত প্রত্যেক ব্যক্তিকেই বোঝায় না, বরং যেকোন আইনগত কার্যব্যবস্থা, কোন দেওয়ানী বা ফৌজদারী যা হোক, চুড়ান্ত রায়দান বা আপীল না করা না হলে চূড়ান্ত গণ্য হবে এইরূপ বায়দান বা অন্য কোন কর্তৃপক্ষ কর্তৃক সমর্থিত হলে চূড়ান্ত গণ্য হবে এমন কোন রায়দান করতে ক্ষমতাপ্রাপ্ত প্রদত্ত প্রত্যেক ব্যক্তি, অথবা অনুরূপ রায়দান করার জন্য আইনবলে ক্ষমতাপ্রাপ্ত যে কোন ব্যক্তি সংস্থাভুক্ত ব্যক্তিকেও বুঝাবে।
উদাহরণ:
(ক) ১৮৫৯ সালের ১০নং আইন মোতাবেক কোন মোকদ্দমায় বিচার-ক্ষমতা প্রয়োগে একজন কালেক্টরই বিচারক।
(খ) যে অভিযোগের বিচারে ম্যাজিস্ট্রেটের অর্থ বা কারাদণ্ডদানের ক্ষমতা রয়েছে-তার দণ্ডাদেশের বিরুদ্ধে আপীল করা যাক বা না যাক- সে অভিযোগে বিচার ক্ষমতা প্রয়োগকারী ম্যাজিস্ট্রেট একজন বিচারক।
(ঘ) যে অভিযোগে ম্যাজিস্ট্রেট কেবলমাত্র কোন আদালতে বিচারের জন্য সোপর্দ করার ক্ষমতাপ্রাপ্ত, সে অভিযোগের ব্যাপারে এখতিয়ার প্রয়োগকারী ম্যাজিস্ট্রেট একজন বিচারক নয়।
